Restricted and Excluded Products

This page is referred to in the Authorised Representative and Responsible Person Agreement and may be updated by Euverify from time to time. A change does not affect a product that has already been accepted for representation unless acceptance is withdrawn under that agreement.

Euverify acts as EU authorised representative, UK authorised representative and responsible person for a wide range of consumer and professional products. Because of their regulatory complexity, risk profile or the terms of our insurance, the products below are either not accepted at all or accepted only after a case-by-case review.

Part A — Products we do not accept

The following are Excluded Products. They must not be added to the product register, and no approval is available for them:

• medicinal products and pharmaceuticals for human or veterinary use, including herbal, homeopathic and prescription-only products, and active pharmaceutical ingredients;
• food, food supplements, feed, feed additives and any product regulated under food or feed law;
• living organisms, plants, animals and animal by-products;
• explosives, pyrotechnic articles, ammunition, firearms and other weapons, and equipment for explosive atmospheres (ATEX);
• medical devices of Class III, and any medical device or in vitro diagnostic device that has not been accepted under a Device Mandate Agreement;
• motor vehicles, aircraft and their components subject to type-approval or aviation safety legislation (other than toy or consumer unmanned aircraft, which are reviewed case by case);
• products whose sale is unlawful in the EU or the UK, products subject to sanctions or embargoes, and products of a business subject to sanctions;
• any product or category that our insurers exclude from cover for our activities as representative, as we notify from time to time.

Part B — Products accepted only after case-by-case review

The following are Restricted Products. They may be added to the product register only after Euverify has given written approval. To request approval, email support@euverify.com with the subject line “Restricted Category Approval” and full product details (description, intended use, applicable legislation, test reports and certificates held, target markets and insurance). Approval may be given subject to conditions, including additional documentation, insurance or fees.

1. Toys and children’s products

• toys within the Toy Safety Directive / Toy Safety Regulation and the Toys (Safety) Regulations 2011;
• childcare articles and products intended for use by children under 14.

2. Medical devices and in vitro diagnostics

• Class I, IIa and IIb medical devices and custom-made devices (accepted under a separate Device Mandate Agreement only);
• in vitro diagnostic medical devices (accepted only where expressly agreed in a Device Mandate Agreement);
• products with medical claims that may fall within the medical device rules.

3. Pharmaceutical, health and drug-related products

• CBD and cannabis-derived products;
• dietary supplements or cosmetics making medical or therapeutic claims;
• e-cigarettes, vaping products and nicotine products.

4. Chemicals and hazardous substances

• biocidal products (disinfectants, pesticides, rodenticides);
• substances and mixtures subject to authorisation or restriction under REACH or classified as carcinogenic, mutagenic or toxic for reproduction;
• hazardous industrial chemicals.

5. Machinery, pressure and gas

• machinery listed in Annex IV of the Machinery Directive or Annex I of the Machinery Regulation;
• pressure equipment and gas appliances requiring notified body or approved body involvement.

6. High-risk electronics and connected products

• 5G network equipment and critical communication infrastructure;
• surveillance, biometric identification and facial recognition systems;
• connected products with significant privacy or cybersecurity risk.

7. Vehicles, mobility and aviation

• e-mobility products (e-scooters, e-bikes and their batteries);
• consumer and toy unmanned aircraft (drones);
• vehicle parts and accessories subject to type-approval.

8. Weapons-related and defence products

• self-defence products (personal alarms excepted), knives and bladed articles sold as weapons, and products subject to export control.

9. Food-contact and animal products

• food-contact materials and articles;
• pet food, supplements and feed additives making health claims.

Products in Part A are never accepted. If we discover that an accepted product falls within Part A, acceptance is withdrawn.

Products in Part B require written approval before they are added. If a product is added without approval, we may withdraw acceptance and terminate the agreement.

The product category shown on our pricing pages (general, moderate-risk, high-risk, cosmetics, medical) is confirmed during our documentation review; a product may be re-categorised, and the applicable fee confirmed, before acceptance.
